Terms of Service

These Terms of Service (“Terms”) govern your use of the Vigil mobile application (“the App”) developed and operated by Synthax Codes SRL (“Synthax”, “we”, “us”, “our”), a company registered as a Moldova IT Park resident in Chișinău, Republic of Moldova.

By downloading, installing, or using Vigil, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Vigil is a safety and navigation app for truck drivers. It provides:

• A map showing points of interest relevant to truckers (parking, truck lots, showers, restaurants, fuel stations, etc.)
• Community-driven POI data where users can add, edit, and review locations
• Route planning that accounts for vehicle dimensions and weight restrictions
• Danger alerts including fuel theft warnings and disputed area notifications

Route information and danger alerts provided by Vigil are advisory only. While we use professional routing services (TomTom) and account for vehicle dimensions and weight, we do not guarantee that any route is:

• Free from road closures, construction, or unexpected restrictions
• Accurate regarding current bridge heights, weight limits, or road conditions
• Suitable for your specific vehicle in all circumstances

You are solely responsible for your driving decisions. Always observe posted road signs, local regulations, and use your professional judgment. Vigil is a tool to assist you, not a replacement for situational awareness.

You must be at least 16 years old to use Vigil. By using the App, you represent that you meet this age requirement.

• When you first open Vigil, an account is automatically created using your device identifier. No email or phone number is required.
• You may optionally add a driver name, which is displayed alongside your contributions.
• You are responsible for any activity that occurs through your device’s account.

By using Vigil, you agree to:

• Provide accurate information. When adding or editing a point of interest, do your best to submit truthful, accurate, and helpful information. Other drivers depend on this data for their safety.
• Not abuse the platform. Do not submit fake POIs, spam reviews, misleading danger alerts, or any content intended to deceive or harm other users.
• Not interfere with the service. Do not attempt to reverse-engineer, overload, or otherwise disrupt the App or its servers.
• Use the App lawfully. Do not use Vigil for any purpose that violates applicable laws or regulations.
• Drive safely. Do not operate the App in a way that distracts you while driving. Pull over to interact with the App when possible.

When you submit a POI, review, or other content to Vigil:

• You retain ownership of the content you create.
• You grant Vigil a worldwide, royalty-free, non-exclusive licence to use, display, modify, and distribute your contributions within the App and related services.
• You confirm that your contributions do not infringe on any third party’s rights.
• We reserve the right to remove or modify any user-contributed content that violates these Terms, is inaccurate, or is harmful to the community.

Danger alerts (fuel theft warnings, disputed areas, etc.) are based on community reports and available data. They are informational and may not reflect current conditions. We do not guarantee the accuracy, completeness, or timeliness of any alert.

• Vigil, its design, content, and brand are owned by Synthax Codes SRL. All rights reserved.
• You may not redistribute, resell, or commercially exploit the App’s content or data.

We strive to keep Vigil available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

To the maximum extent permitted by law:

• Vigil is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy or reliability of any data, routes, or alerts.
• We are not liable for any damages resulting from reliance on route information or danger alerts, vehicle damage, fines, or penalties resulting from following app-suggested routes, or damages caused by inaccurate user-contributed content.
• Our total liability for any claim arising from or related to the service shall not exceed the amount you paid for the App (which is zero for a free app).

We may suspend or terminate your access to Vigil at any time if you violate these Terms, abuse the platform, or for any other reason at our discretion. You may stop using the App at any time.

Upon termination, your right to use the App ceases. Provisions regarding content licences, disclaimers, and limitation of liability survive termination.

We may update these Terms from time to time. Material changes will be communicated through an app update or in-app notification. Continued use of the App after changes constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the Republic of Moldova. Any disputes that cannot be resolved through good-faith negotiation will be submitted to the competent courts of Chișinău.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
